PENALIDADES E SANÇÕES ADMINISTRATIVAS EM CONTRATOS DE SERVIÇOS TERCEIRIZADOS NO SERVIÇO PÚBLICO: REVISÃO SISTEMÁTICA DA LITERATURA

O serviço terceirizado é de grande relevância e importância no serviço público, estando presente principalmente nas atividades meios, a cada ano que passa, a fiscalização de contratos tem sido fundamental para manutenção da eficiência nos serviços prestados, para tanto, a aplicação de penalidades e sanções administrativas se faz necessário. Dados do Portal da Transparência mostram que 69% das sanções aplicadas são as de impedimento de licitar e contratar, considerada uma das mais graves.
Diante disso, o objetivo deste artigo é realizar uma revisão sistemática de literatura que demonstre como é realizado a aplicação de penalidades e sanções administrativas, sobre tudo nas instituições federais de ensino. Para tanto, as pesquisas foram realizadas nas bases de dados Scopus e Web of Science para extração, também foram utilizados o software RStudio com o script bibliometrix para tratamento dos dados que foram submetidos ao Methodi Ordinatio, seguindo os critérios adotados na metodologia, chegou – se ao um quantitativo de 25 artigos. Os resultados e discussões mostram as características dos trabalhos que vem sendo produzidos, a evolução temática e revelaram que há muito a ser estudado para que se possa caracterizar a aplicação de penalidades e sanções administrativas nos contratos de serviços terceirizados. Assim, o trabalho sugere que para realiza tal caracterização são outras pesquisas sejam feitas, evidenciando uma lacuna a ser discutida.
